These Terms of Use and Cookie Policy (“Terms”) constitute a legally binding agreement between you, as a user of CityWalkQuiz (the “App”), and us, the provider of this service, HappyWalks AB. Org.nr559452-5916. By downloading, installing, or using the App, you confirm that you have read, understood, and fully accepted these Terms. If you do not agree to these Terms, you must refrain from using the App. We strongly recommend reviewing this document regularly, as continued use of the App after any modifications signifies your acceptance of the updated Terms.

  1. Collection of Personal Data

We collect and process specific categories of personal data necessary for the functionality, security, and improvement of the App. These categories include, but are not limited to:

  • Location Data (GPS coordinates) – Required for core functions of the App, such as interactive gameplay and location-based features. Location sharing is essential to the intended user experience.
  • IP Address – Automatically collected to manage network communication, security measures, and fraud prevention.
  • Images – If you voluntarily upload or share images in the App, you grant us an unrestricted, perpetual, irrevocable, royalty-free, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such images in any format, including for marketing purposes, without additional approval.
  • Gameplay Statistics – Data on gameplay activity, such as steps taken, distance traveled, and in-game interactions, is collected for analysis and optimization of App performance.
  • Contact Information – If you contact us via email or any support function within the App, we reserve the right to retain such correspondence as long as necessary for customer support, operational improvements, and legal compliance.
  1. How We Use Your Data

All collected data is used to enhance the App’s functionality, optimize user experience, and ensure stable operation. Specific purposes include:

  • App maintenance and optimization – Your data helps ensure availability, troubleshooting, and service improvements.
  • Behavioral analytics – We analyze aggregated data to understand how users interact with the App, enabling us to refine gameplay and engagement.
  • Marketing and promotions – Shared images, gameplay statistics, and other voluntarily provided data may be used for advertising and marketing purposes.
  • Security and fraud prevention – Collected data helps us detect and prevent unauthorized access, malicious activity, or potential security breaches.
  • Legal compliance – If necessary, we may use collected data to comply with legal obligations or respond to legal inquiries.
  1. Sharing Information with Third Parties

We collaborate with external service providers to operate and improve the App’s functionality. Your data may be shared with:

  • Server and cloud service providers – Including but not limited to Supabase, MapBox, Google Maps, and iOS mapping services, to ensure backend stability.
  • Marketing and social media platforms – Including Facebook, Instagram, TikTok, and our website, where user-related content may be distributed.
  • Analytics and tracking services – Used to monitor and enhance user behavior and App development.

We reserve the full right to select and change third-party partners without prior notification to users. However, all service providers must comply with applicable data protection regulations.

  1. Security and Disclaimer of Liability

We implement reasonable security measures to protect your personal data. However, no security system is entirely impenetrable, and we cannot guarantee absolute data security. Users acknowledge and accept the following:

  • Risk of data exposure – Despite our precautions, we are not liable for unauthorized access, hacking, or other breaches beyond our control.
  • Limited liability – We are not responsible for any damages caused by security incidents, service disruptions, or data loss.
  • Third-party responsibility – As we rely on external partners for data storage and processing, security breaches or issues with these third parties fall outside our direct control.

Limitation of Liability

To the extent permitted by law, HappyWalks AB shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App. However, this does not exclude liability for death or personal injury caused by our negligence or any other liability that cannot be excluded or limited under EU consumer protection laws.

Traffic laws and regulations apply in the country and city where you are using the App. You use this App at your own risk, and HappyWalks AB is not liable for any personal injury or property damage incurred during your use of the App.

Disclaimer of Warranties

The App is provided ”as is” and ”as available,” without any warranties of any kind, either express or implied.
We do not guarantee that the App will be uninterrupted or error-free. While we make reasonable efforts to maintain the App’s accuracy and functionality, we cannot guarantee it.

  1. User Rights under GDPR

As a user within the European Union (EU) or the European Economic Area (EEA), you are entitled to rights under the General Data Protection Regulation (GDPR), including:

  •   Access – You may request a summary of the personal data we hold about you.
  •   Rectification – If you believe any information is inaccurate, you may request an update, which we will review at our discretion.
  •   Erasure – You may request the deletion of your data; however, we reserve the right to deny such requests if necessary for our business, legal, or operational needs.
  •   Objection to Processing – You may object to the processing of your data, though this may affect your ability to continue using the App.
  •   Data Portability – Where applicable, you may request a copy of your data in a structured, machine-readable format.

All GDPR-related requests should be submitted to our support team at support@citywalkquiz.com. Requests will be handled within a reasonable timeframe, in accordance with our internal procedures.

  1. Cookies and Tracking Technologies We use cookies and similar technologies to: Ensure functionality – Necessary for authentication, session management, and performance. Analyze user behavior – To enhance the user experience and optimize game mechanics. Marketing and personalization – To deliver targeted advertisements, promotions, and content recommendations. Users who do not want cookies stored on their devices can adjust their browser or system settings. However, disabling certain cookies may affect App functionality.
  2. Consumer Rights and Paid Services

The App is structured in such a way that a code is required to play this game, which can be purchased on our website, www.citywalkquiz.com. If you have purchased the code, EU consumer law provides you with the right to a 14-day withdrawal period for digital content, unless you agree to waive this right for immediate access. Refunds must be requested on our website within 14 days. If you have purchased the code from a retailer, you must cancel the purchase where you bought the code. However, if the code is activated in the App, there is no right of return or refund.

In the event of any malfunction, you have the right to request a replacement of the service as per the EU Digital Content Directive. You agree that no monetary refund will be provided, but if the malfunction is due to our fault, we will provide the user with a new game pass as compensation, and nothing more.

  1. Intellectual Property and Content

All content, including but not limited to text, images, graphics, and quiz questions within the App, is protected by intellectual property laws and belongs to HappyWalks AB or its licensors.
You may not modify, reproduce, distribute, or create derivative works based on the App’s content without prior written consent. Unauthorized use of the content may violate intellectual property laws.

We strive to avoid publishing copyrighted material in the App. If we discover that such material has been published despite our thorough review process, we will remove it immediately.

”Photographic Works” are free to use:

  • If the photographer died before January 1, 1955 (SFS 1960:729, Chapter 4, Section 43), or
  • If the photographer is unknown and cannot be traced, and the image was created before January 1, 1955 (SFS 1960:729, Chapter 4, Section 44).
  • ”Photographic images,” such as press images, are free to use if they were created before January 1, 1975 (SFS 1960:729, Chapter 5, Section 49a).

  1. Termination of Use

We reserve the right to suspend or terminate your access to the App if you breach these Terms or engage in any illegal or harmful activities.
Where possible, we will provide prior notice before such termination. If your account is terminated, this does not affect your rights to data portability or access under the GDPR.
